There are four paths through which individuals might access the courts in response to state coercion/violence: Section 1983; Bivens rights of action (effectively terminated by Egbert v. Boule 2022); exclusionary rules; and habeus corpus. Since Burger, the court has repeatedly acted to diminish the scope of each and to create a "fault rule" based set of threshholds/obstacles.
