Strict Scrutiny

There may be narrower scope for operation of the presumption of constitutionality when legislation appears on its face to be within a specific prohibition of the Constitution, such as those of the first ten amendments, which are deemed equally specific when held to be embraced within the Fourteenth. from UnitedStates-CaroleneProducts (1944) footnote 4.

To pass strict scrutiny, the legislature must have passed the law to further a

• "compelling governmental interest," and
• must have narrowly tailored the law to achieve that interest.

The most exacting judicial scrutiny deployed when

• legislation may touch the Bill of Rights,
• legislation that limits political processes that could reverse legislation,
• statues directed at particular religions or national or insular minorities.
